DISPATCH POLICY

Local 1003 Bylaws read as follows:
Article XII
Section 9 The handling of jobs for unemployed members shall be under the full supervision and discretion of the Business Manager. They shall devise such a means as are considered fair in the distribution of available jobs to qualified members. Members violating any rule or plan established shall be penalized as decided by the Executive board.
Article V
Section 2 The Business Manager may remove any member from any job (when not in violation of any Agreement) for not complying with our Laws and Rules or when they decide the best interest of the Local Union requires such removal. Any such removed member shall be entitled to a review of their removal before the Executive Board
Article VIII
Section 1 Stewards shall be appointed (where needed) by the Business Manager. They shall work under the direction of the Business Manager and be subject to their authority. The Business Manager can remove any Steward, as such, at any time.

The Dispatch rules shall comply with the Collective Agreement and shall not conflict with the IBEW Constitution and Local Union (LU)1003 bylaws.
Section 1 General
(a) There will be no soliciting for work unless written permission is first given by the Business Manager or the LU 1003’ Organizer. Permission shall only be given when the Business Manager considers it to be in the best interest of the Local Union.
(b) Members shall not work for a non-Union electrical contractor unless prior sanction has been given by the Business Manager. The Business Manager’s sanction may be given through the LU 1003’s Organizer.
(c) Members must have a dues receipt for the current month to be eligible for dispatch from the unemployment list.
(d) Members are responsible for updating their Union Worx profile when they become unemployed.
(e) A member’s number on the unemployment list will reflect their latest termination of employment, (i.e. the lower the number on the unemployment list, the longer the member has been out of work.)
(f) When bidding on a job using Union Worx, members with the lowest numbers bid on the job will be selected first.
(g) Members shall be placed in the Local’s records as classified by the Local Union. (i.e. Journey, Apprentice, Welder, Instrument/Technician, etc)
(h) Members shall maintain up to date certification for the Job Ready Dispatch Program in order to be dispatched, as per the Inside Electrical Workers Agreement.
Section 2 SHOP STEWARDS
The Business Manager appoints all Shop Stewards. The Business Manager can choose from anywhere on the Unemployed List, or transfer from any job, an IBEW member to be a Shop Steward.
Section 3 WORK LAY-OFFS
Any member who quits a job within two (2) week period in advance of a company lay-off will automatically be inserted in the proper place as to their Dues Check-Off List placement unless the member has a valid reason that convinces the Executive Board why this should not happen
Section 4 LAY-OFF/DISMISSAL
(a) Where a member is laid off from an ongoing project the member shall be placed on a recall list for re-dispatch to that project until:
(1) Project completion
(2) Referral to another project
(b) Re-dispatch shall be subject to 50/50 ratio restriction.
(c) Where the employer dismisses a member under the provisions of Article 507 (e) of the Collective Agreement for reasons other than reduction in forces due to lack of work, written documentation shall be provided to the Union stating cause.
(d) Where a member is dismissed for just cause twice within a twelve (12) month period, that member shall be barred from referral pending review by the Executive Board.
Section 5 QUITTING A JOB
(a) If a member quits a two (2) week job after accepting a Dispatch from the Hall, the member will automatically be placed at the bottom of the Unemployment List unless they have permission from the Business Manager with a valid reason that would be acceptable to the Executive Board. (i.e. if a member accepts a job for two (2) weeks, the member should work the job for two (2) weeks.)
(b) Members must update their Union Worx profile that they are unemployed if they have not worked for forty-eight (48) hours, not including weekends or holidays.
Section 6 NAME REQUESTS/BOOK CALL RATIO
(a) High Rate (Industrial)
(i) Each IBEW signatory contractor entering Local 1003’s jurisdictional area may choose to bring one (1) name requested member from outside Local 1003’s membership, unless otherwise stipulated in the Collective Agreement or allowance made by the Business Manager.
(ii) Name requested and book-dispatched journeys shall be dispatched on an alternating one (1) to one (1) ratio to a total of fifteen (15) journey members. At no time shall name requests be dispatched consecutively.
(iii) Two journey members, one of whom may be a name request may be transferred between High-Rate projects.
(iv) A 50/50 ratio is to be maintained at all times and no name requests shall be available until hiring ratio is equalized.
This policy shall be based on a company workforce basis. All non-management members shall be counted.
(b) Low Rate (Commercial, Residential, Institutional)
(i) Journey members shall be dispatched on a one (1) to one (1) ratio
(ii) There is no restriction on transfer of members between Low-Rate projects
(c) All requests for specialized skill sets (i.e. boom truck operator, welder, etc.) shall be treated as name requests.
Section 7 APPRENTICES
(a) Unemployed Apprentices, upon completion of their Journey Examination, shall be placed at the bottom of the Journey Unemployed List.
(b) Working Apprentices will be transferred over to the Journey Unemployment List according to the date that they receive their Journey papers and confirmation that they have passed their Interprovincial Red Seal Exam.
(c) Apprentices shall be eligible for term and training hire on residential projects where signatory contractors are in competition with non-union contractors.
(d) Apprentices do not have the privilege of turning down calls for work, unless permission has been given by the Business Manager
Section 8 DISPATCHING
(a) Members will be notified of job calls via the Union Worx app.
(b) It is the responsibility of each member to update their Union Worx profile when they are available for work.
(c) Members are to maintain current contact information on their Union Worx profile where they can be reached.
(d) Upon notification of a job call via Union Worx, a member may choose to bid on this job. The number that the member has been assigned on the unemployment list will be the number that will be bid on this job.
(e) Once accepted for a job, the member will receive contact information on who to report to through Union Worx. Any further information will be conveyed by the employer. At this point the member will be considered dispatched for work and removed from the Unemployment List.
(f) Members who have not been accepted for the job will be notified that they have not been accepted once the job call has been filled.
Section 9 CALLOUTS
(a) If a member changes their mind and refuses to report to the job they have been dispatched to, their name will be placed at the bottom of the Unemployment List unless an acceptable reason has been given to the Business Manager and/or Executive Board.
(b) If the dispatch goes through the List (as per procedure described above) without filling a call, the Dispatcher has the following options:
(i) Contact another IBEW Local to fill the call, starting with BC Locals first, on a shared basis
(ii) Call qualified individuals who have applied for IBEW membership to offer them the call
(iii) Turn back the call to the Contractor, as per ARTICLE 6 of the Inside Wireman’s Agreement, which allows the Contractor to fill the call as they see fit until such time as IBEW members become available.
Section 10 TWO WEEK CALLS OR LESS
(i) While working on a two (2) week call, members are considered to be working and will not be called until the member is unemployed, and they have updated their profile on the Union Worx Unemployment List.
(ii) Member will retain their position on the Unemployment List while on a two (2) week (fourteen (14) calendar day) call.
(iii) Any member accepting a Two Week call does not get another Two Week call for thirty (30) days from the same contractor unless the Business Manager deems it in the best interest of the Local.
Section 11 TRAVEL LETTERS
(a) If a member chooses to Travel to another jurisdiction, they should request from the Business Manager an Introductory Letter to present to the Local Union Hall they intend to Travel to.
(b) Members are required to inform the Business Manager of their plans to Travel
(c) No member shall work in another Local’s jurisdiction without clearance. A member found doing so will have ARTICLE XXIII, SECTION 6 of the IBEW Constitution applied:
(d) No Member shall work in the jurisdiction of another Local Union until their Travelling Card has been accepted or they receive a Working Card, accept by consent of the International Office in special cases, and except in cases where Local Union’s allow their Members to work by agreement or understanding in the jurisdiction of each other.
(e) Any member violating this provision is subject to assessment at the discretion of the Local Union that the member is working in.
**Any Member violating the Working Rules of another Local Union shall be subject to such punishment as decided by that Local Union**
Section 12 If with the permission of LU 1003, a member is performing electrical work for another local on:
(a) Work deemed to be construction by LU 1003’s Business Manager
The member will be taken off the Unemployment List after fourteen (14) working days
(b) Work deemed to not be construction by LU 1003’s Business Manager
(i) The member’s position on the Unemployment list will be frozen if the work is taking place within LU 1003’ geographic area. (i.e. maintenance work at a hospital, pulp mill etc.) Members will be required to notify the Union Hall prior to starting employment in such circumstances.
(ii) If the Union Hall determines that a Member has started employment doing any electrical work as stated above and has not notified the Union Hall, they will be taken off the Unemployment List until they notify the Union Hall that they are no longer working.
(iii) The Member’s name will then be placed at the bottom of the Unemployment List.
(iv) Members who have had their position Frozen on the Unemployment List will have their name reinstated on the Unemployment List in the same position (numerically) as they were before their name was Frozen, when they have informed the Hall that they are unemployed. (i.e. If a Member was #35 when they were Frozen on the list, they will be #35 when their name is Unfrozen)
(v) Members who have their position Frozen on the Unemployment List will not be called for dispatch. As such, the member will not be able to climb the Unemployment List while working in a job situation as stated above.
